According to the lawyer, Michigan's probation requires that someone on probation cannot leave the state without permission from the court. This may be possible if the client informs the court that they are traveling for work. The judge will then allow them to travel.
"Other times, they may have a specific trip planned or a specific event coming up, and we can get that permission right at the time of sentencing. But if something comes up while they're on probation that they don't already have permission for--they have to submit a request through their probation officer for permission to leave the state. Otherwise, if they get found out, it could be a violation of probation," says the Michigan criminal defense attorney.
The lawyer explains that an individual under probation must take their restrictions seriously. It is very simple for law enforcement to conduct a background check and catch someone who has broken probation.
Attorney Paul Tafelski mentions that people under probation are often allowed to work to keep them out of trouble. People on probation must seek or maintain full-time employment. Some people may find it difficult to manage their job. They will need to pass all tests, report to their probation officer, and complete community service.
According to the criminal lawyer, "And so that's what I was referring to when I said that people need to understand while their case is going on how important it is to be able to get the least restrictive terms of probation that are possible. This way it doesn't interfere with your job or your life any more than is necessary."
Attorney Tafelski also suggests that the court might allow the person to pay off some of their fines or costs through additional community service. There are times when the court will be strict and not show sympathy. The judge and the court will make most of the decisions.
