However, it's important to note that a person can still be charged with OWI even if their BAC is below 0.08%. If a person's ability to drive is impaired due to alcohol or drugs, they can be charged with OWI. This means that even if a person has had just one drink, they can still be charged with OWI if their driving is impaired.

For those who are under the legal drinking age of 21, the BAC limit is much lower. In Michigan, anyone under the age of 21 with a BAC of 0.02% or higher can be charged with OWI.
