Essentially, tort is defined as a wrongful act, usually involving personal injury, which leads to a civil case suing for money. Over the years, many reforms have been made to tort-related cases that in Gross’ opinion, puts everyday citizens at a huge disadvantage.

“Tort reform limits an ordinary citizen’s ability to suggest compensation in the courtroom,” Terence Gross said.

Whether it’s medical malpractice, a car wreck, or a slip and fall injury on the job, individuals will be put at a detriment when fighting for compensation. Injured people are fearful to run into medical malpractice caps, which can significantly decrease the amount of compensation an individual receives after a medical mishap. Even if an employee gets hurt on the job due to a manager’s negligent actions, they cannot sue thanks to worker’s compensation immunity.

The worst part about tort reform is that the insurance companies that are meant to protect the people end up benefiting from a civil case, while those injured are forced to suffer. The laws passed essentially deprive a citizen of a respectable compensation amount after injury, which means that an insurance company can fork out a minimal amount of money.

Unfortunately, the amount is usually not near enough to cover medical costs, rehabilitation, or pain and suffering. The Destin personal injury attorney fears for this but knows that he can still find ways to help.

“It’s definitely absurd, but it’s something that we want the average person to know about before they run into an issue like this,” Gross said.
