BloodThinnerHelp.com reports on the status of the initial trials selected as bellwether cases by the Honorable Judge Eldon Fallon of the Eastern District of Louisiana who oversees and manages the multidistrict litigation (MDL) comprised of over 2,800 cases involving Xarelto and allegations that it has caused uncontrollable bleeding in patients using the drug. The primary purpose of the bellwether trials is to be an indicator of how juries might react to the evidentiary testimony presented by attorneys representing Xarelto lawsuit plaintiffs and what their ultimate decisions may be after they deliberate the facts of these cases.
Defendants in all the cases that comprise the MDL are Bayer Healthcare AG and subsidiary company of the Johnson and Johnson Corporation, Janssen Pharmaceuticals. The primary allegation against the makers of Xarelto is that the drug precipitated uncontrollable, life-threatening and sometimes fatal bleeding such as gastrointestinal bleeding. According to plaintiff allegations, the drug has also been linked to strokes, blood clots, and brain hemorrhages. A secondary allegation common to many of the cases is that the manufacturers did not adequately and fully notify the public about the potential risks surrounding the drug.
The court has released information regarding the first 4 bellwether cases that will be heard in early spring of 2017. The dates of the first two trials will be February 6th and March 13th of 2017. The second case dates subsequent to these are April 24th and May 30th of 2017. These 4 cases were selected from an initial pool of 40 lawsuits that Judge Fallon directed to be compiled by January 11, 2016.
The cases included in the MDL have been registered with number 2592.
