Criminal Defense Attorneys Win Case Against Capital Murder Charge

Bryan, Texas law firm Banks & Banks, Attorneys at Law, P.C. got the capital murder charges dismissed for their client, Kevin Godfrey. Attorneys Phil Banks, Amy Banks, and David Barron represented Godfrey on charges stemming from the 2012 death of Hearne City Councilmember Charles Workman.

Godfrey faced life without the possibility of parole if convicted of the murder. Authorities said that a contaminated crime scene, along with lack of evidence connecting Godfrey to the scene, are what prompted the dismissal. Godfrey, along with several members of Workman's own family, maintained his innocence on the charge throughout the trial.

Charles Workman was found dead on September 12, 2012 in his home, as a result of seven gunshots. Godfrey was indicted for the murder after authorities claimed they had enough evidence to tie him to Workman's death. The night before the body was discovered, Godfrey was found at a site where Workman's 2000 Jaguar was set on fire.

He was charged with arson, along with capital murder at that time. Phil Banks, attorney for Kevin Godfrey, said, "Our client maintained his innocence in the Capital Murder charge throughout the case, but admitted his guilt in the arson."

District Attorney Coty Siegert stated that the contaminated crime scene and lack of evidence were just too strong for his office to overcome. He said, "There was a high chance that the state could not carry its burden of proving murder beyond a reasonable doubt. While there was strong evidence of his involvement, being in possession of a stolen vehicle does not prove beyond a reasonable doubt that Kevin Godfrey committed murder."

Godfrey, who has never been convicted of a felony, accepted a plea to 15 years on the arson case, and has served nearly three years, making him already eligible for parole.
