The lawyer mentions that getting guardianship in Texas can be complicated and stressful. However, guardianship is a great tool, especially for those who are responsible for an aging parent, grandparent, or family member who lacks the capacity to make decisions for themselves.

“Guardians are responsible for protecting the estate and guarding the ward to the extent allowed by law. Keep in mind that guardians have limited powers and responsibilities and cannot do anything that was not authorized by the court when they were appointed,” the Houston guardianship lawyer says.

The lawyer explains that the guardian may petition for another order from the court to allow them to act in an expanded capacity, especially if the ward’s disability of incapacity has progressed. A guardian is also expected to make an annual report to the court about the ward’s welfare, estate, and health.

Attorney Whitney L. Thompson adds that people often think that guardians are accountable for the negative actions of their wards. However, the guardian is only liable for the bad acts of their ward if they are also an accomplice to that action.

In the article, attorney Thompson says, “Common misconceptions about the role of guardians are that they can be held responsible for bad behavior. However, this is false. Except where the guardian is personally liable, a guardian cannot be held responsible for bad actions committed by the ward. A guardian does not have to pay for care for the ward with his/her own money.”
