New York laws classify alcohol-impaired driving offenses into two categories: Driving While Ability Impaired (DWAI) and Driving While Intoxicated (DWI). Attorney Bassett explains that both offenses carry their consequences and fines. First-time offenders can expect to pay fines between $300 to $500 for a DWAI and $500 to $1000 for a DWI. These fees do not include the cost of posting bail, court costs, towing charges, and an impound fee.

According to the Long Island DWI lawyer, ”If you are convicted of a DWI in New York, you will probably be ordered to attend substance abuse classes. These legally required classes do not come without their financial implications. A substance abuse class in New York can start at $50 per class, with additional fees for substance abuse counseling at around $200. In addition, you can end up paying the cost of an alcohol abuse screening, which may also be required.”

In addition, having a DWI conviction in New York can also impact the premiums an individual pays their insurance. An individual convicted of a DWI can expect to pay an additional $1500 on average on annual insurance premiums. The conviction can impact insurance premiums for about three years.

Attorney Bassett also mentions that a lot of employers have a zero policy stance for people convicted of a DWI. A conviction can cost a person their job and source of income. Even for people whose employment is not directly affected by a DWI conviction, a significant amount of time would still be spent in court appearances and substance abuse classes. A license suspension will also require a person to seek other modes of transportation, which will likely incur additional costs.
