Hackensack juvenile crimes lawyer Adam M. Lustberg releases a new article (https://www.lustberglaw.com/juvenile-crimes-lawyer/) explaining how a child may be criminally charged in New Jersey. The lawyer mentions that it can be very stressful for a family if their child is accused of committing a crime. The consequences of a conviction have a life-long effect on a child’s life.

“Under certain circumstances, the prosecutor may ask the family court to waive its jurisdiction and to transfer the matter to the criminal division where your child will be tried as an adult. With certain exceptions, and for good cause shown, that application must be made within 30 days of the complaint,” says the Hackensack juvenile crimes lawyer.

The lawyer explains that if a child is tried as a juvenile, they may be moved into a juvenile detention center. Once the child is arrested, their information will then be submitted to a liaison who will do a Risk Assessment. The risk assessment will decide whether the child is allowed to go home or stay in the detention center.

Attorney Adam M. Lustberg says that if the juvenile is remanded to the detention center, they will come before a judge within 24 hours. If the child is considered an adjudicated delinquent, they may face probation, a juvenile intensive supervision program, being placed in a residential facility, or deferred disposition.

In the article, attorney Lustberg adds, “The severity of the crime, your child’s prior criminal history, your child’s age, your child’s record of appearing at previous court proceedings, and your child’s community ties will all be considered in this Risk Assessment. If the juvenile is remanded to the detention center, they will come before a judge within 24 hours and this judge will determine whether they will stay in the detention center or be allowed out until they return to court.”

Lastly, attorney Lustberg emphasizes that having a skilled lawyer is important to ensure that the child and their families understand their rights and that they may be able to receive a more favorable outcome.
