New Jersey criminal defense attorney Adam M. The lawyer mentions that terrorist threats are on the rise around the country. One may think that a “terrorist” is someone from an adversarial country or fringe domestic group, however, anyone may be charged with a terroristic threat crime if they are threatening violence with the intention of terrorizing someone else or a group of people.

“In New Jersey, the threat of violence is taken just as seriously as the actual commission of violence. Under N.J.S.A 2C:12-3, a person can be convicted of a third-degree crime if ‘he threatens to commit any crime of violence with the purpose to terrorize another or to cause evacuation of a building, place of assembly, or facility of public transportation,” says the New Jersey criminal defense attorney.

The lawyer explains that not all terroristic threats are made toward public safety. In many cases, a terroristic threat may be a verbal threat between two individuals who know each other or in other cases of road rage or an alcohol-induced fight in a local bar. A lot of terroristic threats are made in conjunction with a domestic violence situation.

Attorney Adam M. Lustberg adds that the state of New Jersey takes terroristic threats seriously. A threat may be considered a minor flair of anger but the law will consider it something more. If the threat was made to another person, involves the commission of a violent crime, or if the threat caused that person to feel in imminent fear for their life, the person making that threat may face significant time in jail.

In the article, attorney Lustberg also says that if the threat that was made is coupled with a weapon, the defendant may be facing additional weapons charges. When a person is charged with possession of a weapon for unlawful purposes, the penalties will be far more serious.

According to the defense lawyer, “If you are convicted of terroristic threats in New Jersey, you may be facing 3 to 5 years in prison and fines of up to $75,000. But there may be defenses available to you.
