San Diego, California, June 23, 2017 - A recent settlement in San Diego provided insight that any San Diego personal injury attorney should know. A bicycle accident that was the direct result of a sidewalk that had been created by a tree root led to a lawsuit after the cyclist was thrown nearly 30 feet from his bike.

The cyclist who was injured contacted a personal injury attorney in San Diego and was able to recover nearly $5 million in damages in his settlement. The damage to the sidewalk had created an incline which served as a ramp, thrusting the cyclist and his bike into the air. Even if injuries are not as severe or the sidewalk is less damaged, the city could still be held accountable.

Someone who is injured as the result of a damaged sidewalk on either public or private property should take pictures of the damages as soon as possible. In some cases the person responsible for the sidewalk has been known to make quick repairs so the sidewalk seems less dangerous.

It is the responsibility of the city and the local government to maintain roads and sidewalks and to keep them safe. At the very least, those responsible need to post signs warning of the potential dangers of damaged sidewalks.
