New Lawsuit Claims Zofran Caused Heart Defect

A number of lawsuits have been filed against GlaxoSmithKline (GSK), a drug manufacturer, due to allegations of congenital defects resulting from Zofran. The latest lawsuit claims that a child (referred to as B.C.W.) in Texarkana, Bowie County, Texas, was born with severe congenital birth defects as a result of the mother having been prescribed Zofran during pregnancy. It was also claimed that the birth defect has placed significant stress on the family and will continue to do so throughout the child's life. This lawsuit is the latest in a series that started in February 2015.

"B.C.W.'s mother alleges that the drug Zofran, manufactured by GSK, is the proximate cause of the birth defects," says Michael Monheit from ZofranLegal.com. "She also alleges that GSK fraudulently concealed information about the potential effects of Zofran, as she would not have taken the drug had she been aware of these."

B.C.W. was born in 2014. The mother had suffered from extreme morning sickness, which made the pregnancy very difficult. Thus, in the first trimester of her pregnancy, she was prescribed Zofran by her doctor. When BCW was born, he was diagnosed with fluid on the brain, a septal defect (heart murmur), multiple developmental delays, and thickened arteries.

As a result of his birth defects, B.C.W. has suffered horrific pain and suffering. He had to be treated immediately after birth, as he had significant difficulties in breathing, which resulted in him being placed on a ventilator. He was kept in NICU for a long time, as he was not able to ingest nutrition. The complaint,summarized in this article, goes on to state that B.C.W. will require further surgeries in order to enhance his quality of life and manage his multiple birth defects. No history of any such defects exist in the family, which has also been confirmed through extensive genetic testing of the child. Additionally, B.C.W. has an older brother without any congenital defects.

A number of lawsuits have already been filed against GSK for alleged Zofran-caused birth defects.

"Each of the lawsuits is unique," adds Michael Monheit. "However, they all allege Zofran caused birth defects, that GSK fraudulently concealed information from the health communities and mothers in particular about the possible risks of Zofran, that they failed in their duty of delivering a reasonable standard of care, and that they failed to warn the community about the birth defects that have now been associated with the drug."

This lawsuit, however, has seen the introduction of a number of new facts, which were uncovered during research. One of these facts is that GSK is currently being investigated in China, where it is alleged that the company bribed doctors to prescribe their drugs, using travel agencies to hide this. Indeed, GSK has admitted to some instances of this, stating on their own website (http://www.gsk.com/media/press-releases/2013/gsk-statement-regarding-recent-meeting-withchinese-authorities) that "it appears that some senior executives in China appeared to have violated Chinese Law."
