Zofran Lawsuit Judge Moves To Allow Direct Filing For Plaintiffs Joining Boston Multidistrict Litigation

ZofranLegal.com reports on an order given by the Honorable Judge F. Dennis Saylor IV, who is overseeing Zofran birth defect lawsuits consolidated in the Boston MDL. This new order will likely aid in simplifying the filing process for Zofran-related birth defect lawsuits. Judge Saylor noted that plaintiffs filing Zofran lawsuits will now be able to do so directly into the current MDL, to join with hundreds of other cases which have been consolidated there.

Lawsuits consolidated in the MDL were transferred by an order from the U.S. Judicial Panel on Multidistrict Litigation. As the plaintiffs involved have filed against the same defendant, and have expressed common allegations, the cases were consolidated in order to ‘fast track’ legal proceedings and conserve the time and finances of those involved. The new ruling now essentially ensures that rather than requiring plaintiffs to initially file in the federal court of their own states prior to having their cases transferred to join those in the MDL, those filing will now be able to do so directly on the MDL docket, thus greatly simplifying the filing process.

This new order is Judge Saylor’s sixth, and should greatly help future Zofran lawsuit plaintiffs as they look to file. The lawsuit numbers are expected to continue to grow in number as time goes on. Lawsuits which have been consolidated in the MDL were filed against pharmaceutical giant GlaxoSmithKline, who is the manufacturer of anti-nausea drug Zofran. Plaintiffs involved similarly allege that fetal exposure to the drug through their mothers causes unborn babies to develop serious and potentially fatal congenital birth defects. Defects which are most commonly named in the lawsuits include: clubfoot, congenital heart defects, transposition of the greater vessels, respiratory distress, kidney defects, and cleft lip and palate.
