Zofran Lawsuit Plaintiff Alleges Infant Was Born With Hypoplastic Right Heart Syndrome Due To Drug Exposure

ZofranLegal.com reports on the filing of a lawsuit referencing Zofran and birth defects. The complaint was filed against pharmaceutical giant GlaxoSmithKline, as they manufacture the anti-nausea drug in question. It was filed by a mother from Illinois who claims that fetal exposure to the drug caused her son to develop a serious heart defect. In addition, she claims that defendant GSK’s, “conduct has caused devastating, irreversible, and life-long consequences and suffering to newborns and their families.” In stating this, the plaintiff is not just speaking for herself but is voicing concern for the hundreds of other parents who have also filed strikingly similar Zofran lawsuits of their own.

In court documents, the mother states that she was prescribed Zofran by her doctor while expecting. She took the anti-nausea drug to help combat nausea associated with morning sickness during her first trimester. Although the first trimester is a time when pregnant mothers often suffer from nausea, it is also a time when the fetus undergoes rapid cell division and completes much of its initial heart, mouth, and limb tissue development. The plaintiff alleges that after taking Zofran, she gave birth to a son in 2012 who was diagnosed with hypoplastic right heart syndrome.

Hypoplastic right heart syndrome is a congenital birth defect which develops when the right side of the heart becomes malformed and is not able to adequately pump blood throughout the body. This is known to restrict blood flow to the lungs, and frequently causes babies with this condition to have a bluish hue to their lips, fingernails, and other body parts.

The plaintiff indicates her son needed heart transplant surgery, and continues to require medical care today. In a controversial marketing move, GlaxoSmithKline advertised Zofran as a safe and effective treatment for morning sickness although it has never been FDA-approved for this use. This is considered “off-label” marketing, and is a major point of contention with many current plaintiffs.
