Third Risperdal Lawsuit Lost By Johnson & Johnson Subsidiary Janssen Pharmaceuticals

LegalHerald.com comments on reports that a Philadlphia jury gave pharmaceutical giant Johnson & Johnson their third trial loss concerning the antipsychotic drug, Risperdal, which they manufacture through subsidiary company Janssen Pharmaceuticals. This trial ended in an order for Johnson & Johnson to pay $500,000 to the filing plaintiff.

Details of the case show that a boy from Wisconsin used the drug and reportedly developed gynecomastia. This is a medical condition in which males develop significant breast tissue, making their breasts resemble that of females. The condition can cause emotional turmoil as young boys are often taunted and bullied for having breasts.

In this particular case, it was reported that the jury returned a verdict within just six hour’s time, finding the defendant guilty of neglecting to warn consumers and physicians regarding the risks associated with their drug. They additionally found that the drug caused the young man’s breast growth.

This young man, unfortunately, is not alone in his allegations regarding Risperdal. Many others across the nation have filed lawsuits referencing the drug and claiming much the same. In fact, it has been reported that over 1,600 other cases are currently awaiting their day in trial at the Philadelphia Court of Common Pleas.

Because this case marked the third loss for manufacturer Johnson & Johnson and the prior two losses also resulted in awards of $2.5 million and $1.75 million to plaintiffs, many believe that it is possible that these outcomes will spur the corporate giant to consider settlement for future lawsuits. Those involved indicate that if a jury was able to link these plaintiffs’ use of Risperdal to the development of gynecomastia, it is likely that future juries will also be able to do the same for many of the 1,600 other awaiting plaintiffs. In this case, it may be considered most beneficial for Johnson & Johnson to settle things outside of court and cut their losses by offering a blanket settlement without spending time and finances battling.
