AbuseGuardian.com reports on a complaint filed in the Court of Common Pleas in Philadelphia County under number 150703385. The case names Massage Envy as one of three defendants and was filed on September 14, 2015. The plaintiff alleges that Massage Envy is negligent and responsible for the alleged sexual assault against her which took place at the hands of their massage therapist.
On May 2, 2015, the Plaintiff went to the Massage Envy in West Chester, PA for a massage. Her therapist was James Deiter, who had previous complaints of sexual assault made against him. The Plaintiff was not made aware of the previous complaints, and during her massage alleges that Deiter sexually assaulted her. She went to the police the same day to file a report and when the police investigated, Deiter admitted to assaulting the Plaintiff and several other female clients. Deiter was arrested and charged with multiple violations of Pennsylvania law.
There are a rising number of lawsuits across the country naming Massage Envy as negligent and responsible for the sexual assaults that have taken place at their franchise locations. The court documents in this case state that there are “ more than fifty (50) allegations of sexual assaults by Massage Envy therapists occurring in approximately fifteen (15) different states.” Massage Envy claims that they adhere to a strict zero tolerance and code of conduct policy, and require a background check prior to working in any of their franchise locations, yet many plaintiffs are now questioning the sincerity of these statements.
Sexual assault can have devastating effects on its victims. According to RAINN, the most common effects are (but not limited to): post traumatic stress disorder, self-harm, flashbacks, depression, sexually transmitted infections, and substance abuse. Many of the plaintiffs in these sexual assault cases allege to have sustained injuries that require medical care and continue to plague them even long after the event occurred.
