Brisbane City, Queensland based LEAD Conveyancing Brisbane is reaching out to share important facts everyone should know about conveyancing. The team members at LEAD Conveyancing have long established themselves as experts in property conveyancing across Queensland.

Kristy Fletcher of LEAD Conveyancing Brisbane says, “Buying new property can be an exciting time for us all, but it can also get quite stressful if you don’t know all of the complex parts of the process. Conveyancing is just one such part — where if you don’t know the general terminology or the structure of the process, you might be confused as to what is going on. At LEAD Conveyancing Brisbane, we want our clients to have a clear understanding of the process, so we are here to help.”

As the company shares, in legal terms, Conveyancing is the legal or statutory process of transferring the title of a particular property from the owner to a buyer. The process generally starts with the owner and the buyer entering into a contract which sets out the terms on which the property is to be sold. Once contracts have been agreed upon and exchanged, the buyer and the seller are legally obliged to finish the transaction. Until that point, however, either party is free to withdraw without any legal liabilities.

When contracts have been exchanged, the buyer must also pay a deposit. Usually this amounts to about 10% of the full purchase price, which the seller is entitled to ask. In cases where this might not be possible, the help of a conveyancer is useful to figure out the best course of action. To complete the conveyance process, the buyer has to transfer the full amount of the purchase to the seller. Once the money has been transferred, the transaction is complete, and the keys will be handed over to the seller. If either party fails to complete the transaction by the agreed date, they will be in breach of the contract, and the defaulting party will have to compensate the other for any financial loss suffered (in addition to paying a penalty under the terms of contract).

Fletcher says, “The legal process of transferring property is complicated. It is no surprise that people have trouble understanding it. Knowledge is vital when engaging in high stakes transactions, and we want all our clients to feel educated about what they are doing. Our goal has always been to make the conveyancing process as easy as it can be for our clients. Buying and selling property is stressful enough without adding extra complexity on top, and LEAD Conveyancing Brisbane is here to make things as smooth and simple as possible.”
