The lawyer mentions that the duration that a worker may be able to collect benefits varies on the degree of their injury or illness. “When a worker has been determined to have suffered from a permanent total disability, their l be no limit in how long they will be able to collect benefits. For anything less than a permanent total disability, there will be a maximum number of weeks that a worker can receive benefits as set out by the 2018 impairment guidelines by the Workers’ Compensation Board,” the Queens workers' compensation attorney says.

The medical evaluation may also be able to determine if the worker has reached maximum medical improvement and has recovered as much as possible from their injury. The worker will be required to visit a doctor every six weeks to establish their disability.

The lawyer adds that a workers’ compensation lawyer may be essential if the doctor or the patient disagrees with the insurance doctor’s findings. If there is a substantial difference in the opinion between the doctor and the insurance company’s doctor, the workers’ compensation board may review the findings and decide whether the injured employee should continue to receive benefits.

In the article, attorney Sanchez adds, “Maximum weekly benefits for an injured worker is two-thirds of the New York State average weekly wage for the previous calendar year. From the period of July 1, 2020, through June 30, 2021, that amount is $966/78 based on the average weekly pay of $1,450.17 determined by the New York State Department of Labor for 2019.”
