New York City child abuse and neglect lawyer Ethan Steward (https://www.newyorkfamilylawgroup.com/practice-areas/child-abuse-neglect/) releases a new article explaining what happens after abuse or neglect is reported in New York. The lawyer mentions that child abuse and neglect accusations are taken very seriously. They can dramatically change a child’s home life and can involve a wide variety of organizations such as the Child Protective Services (CPS), the police, and the Department of Social Services.
“First, Child Protective Services will investigate the charges of abuse or maltreatment within 24 hours. Depending on the results of the investigation, they may choose to put the child into protective custody and offer the family additional, appropriate services. The investigator may also file certain petitions with the family court,” the New York City child abuse and neglect lawyer says.
The lawyer explains that the CPS will have 60 days to determine if the report was true or false. The results will then determine whether criminal charges will be brought against the responsible party. If the ACS or Administration for Child Services has been tipped that a person has been abusive towards their children, an investigation will commence.
Attorney Ethan Stewards adds that the parent will then receive a letter informing them about the matter and the subject of the investigation. ACS will then have 60 days to complete the investigation. Being accused of child neglect and abuse can be very daunting. The parent may be asked to show up in court and the children can be placed in foster care.
In the article, attorney Steward adds, “If a child is being abused by the other parent, Child Protective Services will immediately begin investigating your home situation to determine whether or not child abuse or neglect has occurred. If the investigator finds that the child is being abused or neglected, they will file an Article 10 petition in family court. This starts the process of determining whether or not the child should be removed from the home in the long term.”
