The lawyer mentions that arson is defined as burning a building or structure so that an individual may be able to collect insurance money for another unlawful purpose. If the property that was burned was not owned by the person accused and only burned due to recklessness, they can still be charged with arson.
According to the New Jersey arson attorney, “In New Jersey, arson charges fall into two categories – ordinary arson and aggravated arson. The lesser offense of ordinary arson describes the crime of starting a fire or explosion on your own property or another person’s property.”
The lawyer explains that aggravated arson occurs when a person knowingly or purposefully sets fires for a certain reason. These reasons include exposing someone to death or injury, destroying a building owned by someone else, burning a building to collect insurance, and purposely damaging or destroying a forest.
Attorney Adam M. Lustberg mentions that the potential penalties or punishment for aggravated arson are a prison term of up to 10 years. Some cases can have a potentially longer sentence depending on the circumstances surrounding the case.
