Hackensack drug crimes attorney Adam M. According to attorney Lustberg, laws regarding low-level drug use have changed over the past few years. Some drug laws may prove ineffective so some states have begun to reconsider outdated drug classifications.

"While hallucinogenic mushrooms are still considered Schedule 1 drugs in New Jersey, possession of small amounts has been reclassified. Now, instead of being charged with possession of a controlled substance, if you have been found with one ounce or less of these mushrooms, the most stringent penalty will be six months in jail and a maximum fine of $1,000 under the new classification," says the Hackensack drug crimes attorney.

The lawyer explains that the federal government had banned "psychedelic” mushroom use in 1970 as a way to put a stop to recreational drug use. The "war against drugs" has proved inefficient and costly and often targets the most low-level offenders.

Attorney Adam M. Lustberg adds that the compound psilocybin is found in hallucinogenic mushrooms. This compound is psychoactive and was designated a Schedule I controlled substance under the Controlled Substances Act. However, the drug is now classified in New Jersey as other potentially harmful substances.

In the article, attorney Lustberg writes that several states and cities across the country have made these mushrooms a priority for law enforcement and decriminalized them. New Jersey considers selling or carrying out hallucinogenic mushrooms to be a criminal offense. But, as of February 20, 2021, possession of less than an ounce is considered a disorderly person's offense.

According to the criminal defense lawyer, "Possession of a Schedule I controlled dangerous substance, of which mushrooms are still considered, can be charged and prosecuted as a third-degree offense. If you are found with over an ounce of these mushrooms, you can still face up to 5 years in prison and fines of up to $35,000. Furthermore, you will have a criminal record that may follow you for the rest of your life."
