The lawyers mention that everything in the DWI timeline is important for the attorney handling a person’s DWI case. There are many procedures that the police need to follow and any mistake the law enforcement officers make can be used for the client’s benefit.
“According to the timeline, when you are pulled over, the officer will generally ask for your license and registration, which you should have ready by the time the officer comes to you so that you can just hand it to them without having to engage in a lot of conversation. Attorney Russ Kofman explains that if the officer is able to smell alcohol on the person accused, or if the person admits to drinking, then they will be pulled out of the vehicle and be administered a portable breath test. The person may also be asked to do a field sobriety test, or they can also be taken to the precinct.
Criminal defense attorney Arthur Lebedin adds that after an individual is administered a breathalyzer or taken to the precinct, the defendant will see the judge for bail. The case will then be adjourned for approximately a month. The attorney will then need to file for motions, litigate issues, and file for discovery.
The lawyers also say in the article that more complicated cases usually take up to six to eight months. There are some cases that can even take up to a year when the prosecutor and the judge refuse to give a deal but the defense lawyer feels that there is room for an argument. In rare cases, these cases could go up to two years.
