According to the lawyer, a couple can enter into a marriage and it is assumed that they will live together and engage in sexual intercourse. However, this is not true for all marriages.

“A marital partner may only seek an annulment based on specific criteria. In the case of consummating a marriage, it is only necessary grounds for annulment if one party has a physical incapacity that prevents them from doing so, and it was discovered after the marriage,” says the New York City annulment attorney.

The lawyer explains that an annulment is when the court declares that a marriage is invalid. Even if the marriage was valid at the time of marriage, a marriage can be annulled.

Attorney Ryan Besinque adds that an annulled marriage is void. While marital records can be retained, the couple can declare their marriage over. The annulment of marriage may make the marriage null, but it won't affect the legitimacy or the responsibilities of the parents to their children when it comes to parenting.

Attorney Besinque also lists five reasons why a New York marriage could be canceled. One of these reasons is that one or more of the partners is too young to be involved in a marital partnership, one of the marital partners is mentally ill, incapacitated, or one partner has an incurable mental disorder. Other reasons can also be that the consent to the marriage was obtained by force or that there is no physical capacity for one partner to consummate the marriage.

The divorce lawyer also explains that child custody and support must still be considered when minor children are involved in an annulment. The court will order child custody and support in this instance, just like a divorce.
