There are several different forms of DWI offences. The first is 4th Degree Driving While Impaired, which is the lowest level of DWI. In Minnesota, there are several ways to get a Fourth Degree DWI, some of which include being under the influence of alcohol, controlled or hazardous substances or any combination of 2 from the previously listed options. A 3rd Degree DWI is a Gross Misdemeanor offense in the state of Minnesota. It has a maximum penalty of up to a year in jail and a $3,000 financial penalty. A Third Degree DWI occurs if the person involved is refusing to submit to a test of intoxication and has no alcohol related license revocations in the last decade, or any previous DWIs. If one has any of the last 2 options, it will DWI with aggravating factors as well. This aggravating factor will also be a requirement for driving under influence of a controlled or hazardous substance.

A 2nd Degree DWI is a more serious Gross Misdemeanor offense than 3rd Degree DWI, but also carries a maximum sentence of 365 days in jail and a $3,000 financial penalty. A Second Degree DWI happens when all the criteria of a 3rd degree are present with an additional aggravating factor in each class of offense. A 1st Degree DWI is considered Felony Offense in the state of Minnesota. It is the most serious level of DWI, with a maximum sentence of up to seven years in prison and a $14,000 financial penalty.
