According to the firm, the State of Arizona only allows an adult to adopt another adult under three very specific circumstances. First, the adult to be adopted must be at least 18 years of age, but not more than 21 years of age, regardless of the relationship with the adopting adult. Second, the adult who is being adopted, no matter the age, must be a step-child, niece, nephew, cousin, or grandchild of the adopting person. Finally, an adult may be adopted by a foster parent so long as that adult was placed with that foster parent as a juvenile and the foster parent has maintained a continuous family relationship with them for at least five years.

The law firm explains that adult adoption can be used in same-sex marriage situations for the parent’s partner, who was unable to be a legal parent to the couple’s child under previous law, to officially adopt the now adult child. If the adopting adult is married, there is an option for their spouse to also adopt the adoptee. However, if the adopting adult is married but the spouse is not adopting, then that spouse must consent to the adoption for the process to proceed. Similarly, if the adult being adopted has a spouse, then that spouse must also give consent to the adoption for the adoption to proceed.
