They advised attorneys to be mindful of their clients’ social media activities, especially during ongoing legal cases.
Titled ‘Social Media and the Client: Practical Guidelines to Avoid Potential Pitfalls,’ the talk focused on problems that can occur as a result of a client’s social media updates, particularly in cases of personal or work-related injury cases. It also included advice on how attorneys could avoid running into these issues, such as practical guidelines for them to address with their clients and how to avoid some of pitfalls they would face during representation.
“For more than 10 years now, social media has been an increasingly invasive part of our daily lives. As part of this, most people feel compelled to put things on social media to tell the world, regardless if it’s good or bad. Often, however, this can create problems when they have legal matters that are ongoing," said Bernard Nomberg of The Nomberg Law Firm, who delivered the talk at the luncheon on behalf of the firm.
The usage of social media is indeed so common that users rarely pay much attention to their updates with respect to the consequences they can have. Since privacy still remains a big issue, the researchers on the other side can easily dig out social updates during a legal case that were not meant for the public world. These findings can be used out of context to build any number of arguments, which is why it is advisable for plaintiffs to be careful of what they post on social media. Furthermore, it is also advisable for their attorneys to be careful of these updates, so they don’t get blindsided by the opposing counsel.
