He has noted a sharp increase in the number of people who have been involved in trucking accidents in particular. "It has recently been on the news that a truck driver from Kentucky as well as his employer are facing a number of lawsuits as a result of a fatal crash in June," says Mike Breen himself. "Six people had died in this crash and their relatives as well as survivors have now filed a civil lawsuit for personal injury and wrongful death, totalling to more than $30 million. The June crash was one of the worst in the state's history. It quickly became apparent that the driver had allegedly tested positive for drugs and that he also violated the commercial hours-of-service regulations, which are federally mandated. The crash actually occurred in Tennessee, killing six people and injuring another 12. The Bowling Green auto accident attorney points out: "The reason why the driver is now facing vehicular manslaughter, reckless aggravated assault, DUI, speeding, and making false report charges is likely to be the fact that the man had been working for 45 hours straight. Unfortunately, we see this too often in trucking accident cases."
Mike Breen has found in his research that there has been a 20% increase in truck accidents over the past two years. Just 3% of the accidents that cause injuries involve large trucks, but when they do, the injuries are often much more severe. He explains: "This is mainly due to the size and weight of the truck and due to its cargo."
The attorney's research also showed that most accidents happen when trucks change lanes and that it is particularly common for multiple vehicles to be involved. While driver error can be a cause, maintenance issues, improper repair, loading issues, defective equipment, and mechanical issues are also common causes.
