As the country continues to advance technology and legislation, judicial activism will make itself more and more relevant. The Constitution’s laws were not created around the same facets of life that citizens face today. Therefore, modern judicial activism usually involves how constitutional legislation is interpreted. Gross said, “Everyone knows that the second amendment is a highly-discussed issue. Because our ancestors couldn’t predict our advances in weaponry, a lot of us are confused on how it should be translated.”

Often times legislators will push their own translations of a law instead of strictly following old legislation. While the intent is good, this usually results in a debate from a difference in political stance.

Constitutional legislation doesn’t always represent the era’s zeitgeist. Some judicial activism aims to refine preexisting laws so that they better relate to the current age. Such finger pointing tends to create further division among the political parties.
