Xarelto Lawsuit Plaintiffs Allege Commercial Misleads Public Regarding Drug

TheProductLawyers.com reports on the allegations of plaintiffs who claim that the advertising campaign undertaken by Janssen Pharmaceuticals, a subsidiary of the Johnson and Johnson Corporation, and Bayer AG, was misleading. They claim that the makers of Xarelto have retained celebrities and famous athletes to endorse the benefits of Xarelto, but failed to sufficiently state the potentially dangerous risks involved with taking the drug.

The commercial which they refer to features Saturday Night Live star Kevin Nealon, golf great and legend Arnold Palmer, NBA star Chris Bosh, and NASCAR driver Brian Vickers. Each of these celebrities endorses the benefits of Xarelto and provide information about the drug but fails to mention risks such as excessive bleeding that may cause death.

There have been thousands of lawsuits filed against Janssen and Bayer since the drug was released to the market with over 2,800 being consolidated into a multidistrict litigation (MDL) in Louisiana under the oversight of the Honorable Judge Eldon Fallon. Another 550 cases have been consolidated in a mass tort program in Philadelphia, PA. The plaintiffs in these cases have a much different view of the drug than that expressed by the celebrity spokespersons in the Xarelto commercial. Many plaintiffs are questioning the tactics of the manufacturers and feel the ad is very misleading. They allege that Xarelto puts them and potentially many others at the risk of severe uncontrollable bleeding.

It should also be noted that the U.S. Food and Drug Administration (FDA) has issued two black box warnings for the drug since the agency approved it for release to the market. Black box warnings are quite severe since these warnings can frequently indicate that a product is about to be pulled from the market.
